Terms of Use
Effective: [DATE] · DRAFT — pending attorney review
These terms are an agreement between you and [CareCrib LLC] ("we") for the CareCrib app and website. By using the app you agree to them. You must be 18 or older.
1. A diary, not medical advice
CareCrib is a record-keeping tool. It does not diagnose, treat, monitor or predict any condition, and it does not calculate doses. Charts, summaries and reports only reflect what you entered. Always follow your child's care team. Reminders can be missed or delayed — do not rely on the app as the only way to give medications on time.
In an emergency, call 911 or your local emergency number. Do not wait to log anything.
Home monitor readings (for example Owlet®) are entered by you; we are not affiliated with or endorsed by Owlet or any device maker.
2. Your data
Your records belong to you. How we handle them is described in our Privacy Policy and Consumer Health Data Privacy Policy. You are responsible for keeping your devices and your Family Sync passphrase safe; if you lose the passphrase, we cannot recover the encrypted family copy. Keep backups using the export feature.
3. Subscriptions
Some features may require a paid subscription purchased through the Apple App Store (or Google Play). Payment is charged to your store account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can manage and cancel them in your store account settings. Refunds are handled by Apple or Google under their policies. Prices may change with notice before your next renewal.
4. Acceptable use
Don't misuse the app or our servers: no attempts to access other people's data, overload the service, reverse engineer it to defeat security, or use it for unlawful purposes.
5. Availability and changes
We may update, change or discontinue features. We will give reasonable notice before discontinuing Family Sync so you can export your data.
6. Disclaimers
The app is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law, including warranties of accuracy, fitness for a particular purpose, and uninterrupted or error-free operation.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost data, arising from your use of the app. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or US$50 if you paid nothing. Some jurisdictions do not allow these limits, so they may not apply to you.
8. Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. This does not take away consumer protections you have under the law of the state where you live.
9. Changes to these terms
We may update these terms; we will change the effective date and show a notice in the app. Continuing to use the app after that means you accept the new terms.
